Here's an interesting case involving a medical marijuana patient and his employer who fired him after a positive illegal drug screen. The ruling also has interesting implications as to how define a disability. The Oregon Supreme Court narrowed the definition of disabled significantly. Another interesting point that did not get a chance to be determined is how much marijuana in his system would impair him. Oregonian LINK

In a widely watched employment case, the Oregon Supreme Court on Thursday ruled against a former millwright who sued Columbia Forest Products Inc. after being fired for smoking marijuana at night to alleviate leg spasms that prevented him from sleeping. The court ruled that Robert Washburn did not qualify for protection under Oregon disability law because medication allowed him to function normally. color: rgb(0, 102, 0);">The decision addressed Washburn's specific circumstances, but it offered no guidance for other employers who are grappling with whether they must accommodate disabled workers who smoke medicinal marijuana.
But on a broader issue, Oregon's top court followed a controversial 1999 U.S. Supreme Court decision that significantly narrowed the number of workers who are covered by the Americans with Disabilities Act. The Oregon Court ruled that Washburn may have a disability, but because medication allowed him to function normally, he does not qualify as disabled.


I used my sleep disorder as a factor in my disability claim. I have a moderately severe sleep disorder where I do not get any restorative sleep. This is the deep sleep that refreshes, repairs, and rejuvenates us. I have a condition called alpha wave interrupted sleep pattern and I dream actively.
Epic dreams. Every night. It is also a symptom of Fibromyalgia. This entry from Wikipedia explains:

Chronic sleep disturbances are also characteristic of fibromyalgia, and some studies suggest that these sleep disturbances are the result of a sleep disorder called alpha wave interrupted sleep pattern, a condition in which deep sleep is frequently interrupted by bursts of brain activity similar to wakefulness. Many patients experience "brain fog," which is objectively proven abnormally slow brain waves and objectively proven cognitive deficits.


Marijuana is effective for me as a sleep aid, as there is no way I'm taking that crap Ambien. Imagine driving in your pajama......if you wear any? I'm curious to see mug shots of these Ambien drivers who crash into things. Do they still have their night clothes on?
